Social Security Administration Ruling

Update (April 13, 2009)

Read report by Federal Section 218 Task Force for Missouri School Districts.

Certificated Employees – Effects of Social Security Ruling

We have received a number of telephone calls regarding a new ruling by the Social
Security Administration which states that the only public school employees exempt from
paying social security are PSRS members in the positions of teacher, teacher-secretary,
substitute teacher, supervisor, principal, supervising principal, superintendent, assistant
superintendent, nurse or librarian who were duly certificated under the laws governing
the certification of teachers. The change is scheduled to take place July 1, 2009.

We realize this is a major change in direction for Social Security and has implications for
a number of District employees who are certificated but not currently working in the
positions exempted by Social Security.

We have been in touch with PSRS/PEERS in an effort to clarify the impact of such
actions and will forward any information we receive.

At this time I would refer you to a video presentation provided by Alan Thompson the
legal counsel for PSRS/PEERS.

More information about this issue is available on the PSRS/PEERS website.
